Barton, 34, has been training with the Clarets after leaving Rangers in November and will sign in January until the end of the season.
But the midfielder, whose contract at Ibrox was terminated following a training-ground bust-up, will have to wait to resume his career.
He was given a one-match ban for breaking Scottish Football Association rules on gambling at Rangers.
And the ban will apply in the Premier League because of an agreement between the home nations.
Barton helped Burnley win promotion as champions last season and was named the club’s player of the year.
He then joined Rangers on a free transfer in the summer, but made just seven appearances north of the border.
Barton has been undergoing a rigorous training regime in order to get up to speed to compete for a place in Sean Dyche’s squad.
The former Manchester City, Newcastle and Queens Park Rangers midfielder said: “It’s great to be back!”
